ESOS Phase 3 – Compliance Notification Enforcement Extension

The Environment Agency has announced that the new ESOS compliance reporting system will go live on 19th March 2024.

The Environment Agency has announced that the new ESOS compliance reporting system will go live on 19th March 2024.

The reporting system will be released in two stages:

  1. Initial release allowing participants to register as system users and update their organisational accounts.
  2. Further release is planned towards the end of April 24’ to allow participants to complete their final compliance notifications.

Compliance Notification Enforcement Extension announced

Delays in releasing the new ESOS reporting system have resulted in extensive discussions between the Environment Agency and the Department of Energy Security and Net Zero regarding concerns about the timeframe for participants to complete their notifications.

To ensure participants are given reasonable time to complete their compliance notifications a compliance notification enforcement extension has been agreed.

Key ESOS Phase 3 dates agreed upon are:

  • ESOS reporting system initial release — 19 March 24’
  • Further ESOS reporting system release — second half of April 24’
  • User system registration must be complete by 5 June 24’
  • The deadline for ESOS compliance notification remains 5 June 24’
  • Regulatory enforcement extension until 6 August 24’

The Environment Agency is still encouraging ESOS participants to meet the compliance notification deadline of 5 June 24’ where possible. The enforcement extension has been introduced to provide participants with a grace period to complete their notifications on time.

Our advice to ESOS participants, given the new timeline, is to maintain momentum to meet the 5 June 24’ compliance deadline.

ESOS Phase 4 is already underway. New annual reporting notification requirements mean you will need to submit an Action Plan by 5 December 24’.

Defining your Action Plan will require significant due diligence as you will be held accountable should you not meet your targets.
